1. Agreement to these Terms

These Terms and Conditions, together with the Edge to Ease Privacy Policy and any applicable pilot agreement, employer agreement, consent form, order form, or other written agreement, govern your use of the website and services.

If a signed agreement between Live As If Co. and an organizational client conflicts with these Terms, the signed agreement controls for that client to the extent of the conflict.

2. About Edge to Ease

Edge to Ease is offered by Live As If Co. It provides workplace education, structured check-ins, supportive practices, and privacy-conscious Capacity Intelligence intended to help organizations recognize aggregate workforce strain patterns and support employee capacity.

References to “Edge to Ease,” “we,” “us,” or “our” in these Terms mean Live As If Co. and the Edge to Ease service, as appropriate.

3. Eligibility and authority

You must be at least 18 years old to use the services. If you use the services on behalf of an organization, you represent that you have authority to act for that organization and to accept these Terms on its behalf.

You are responsible for providing accurate information and for keeping any access credentials confidential. Notify us promptly if you believe your account or access link has been used without authorization.

4. Services and participation

Edge to Ease offerings may include assessments, check-ins, educational materials, supportive exercises, pilot programs, aggregate organizational reporting, communications, and other related services. Specific features, schedules, participation periods, and deliverables may vary by program or organizational agreement.

Participation may require you to submit information about your work experience, capacity, stress, recovery, or use of supportive practices. You may choose not to answer an optional question. Certain required information may be necessary to provide a requested feature or complete a program step.

5. Not medical advice, diagnosis, or treatment

Information, scores, stories, suggestions, and practices provided through Edge to Ease are for educational and supportive purposes only. They do not diagnose, treat, cure, or prevent any medical or mental-health condition and should not be used to make medical decisions.

If you have a health concern, seek advice from a qualified healthcare professional. If you believe you may be experiencing an emergency, call 911 or your local emergency service immediately.

6. Not intended for individual employment decisions

Edge to Ease is not designed to evaluate individual job performance, fitness for duty, promotion eligibility, compensation, discipline, or termination. Employers and other organizational clients are responsible for their own employment practices, policies, and legal obligations.

No information provided through Edge to Ease should be interpreted as legal, human-resources, or employment advice.

7. Optional wearable information

Some offerings may allow a participant to use a Smart Health ring or voluntarily submit wearable-derived information, such as sleep duration or heart-rate variability. Wearable readings are estimates and may be incomplete, delayed, or inaccurate. They are not medical measurements and should not be used for diagnosis or treatment.

Wearable participation is optional unless a separate program agreement clearly states otherwise. Edge to Ease does not use wearable information to identify an individual for employer reporting. The Privacy Policy and applicable consent language explain what wearable-related information is collected, how it is used, and with whom it may be shared.

8. AI-assisted content

Edge to Ease may use third-party artificial-intelligence services, which may include Anthropic Claude, OpenAI ChatGPT, or Perplexity, to help generate Daily Clarity Stories, summaries, educational content, or other supportive material.

AI-generated content may contain errors, omissions, or unexpected results. It is provided for reflection and education, not as medical, legal, employment, or professional advice. You should use your own judgment and consult a qualified professional when appropriate.

We may review, revise, limit, or discontinue AI-assisted features at any time. Additional information about data handling by service providers is included in the Privacy Policy.

9. Aggregate employer reporting

Employer reports are designed to present combined, aggregate, and de-identified patterns rather than individual participant entries, scores, responses, wearable readings, or biometric information. We do not intend employer reports to identify a participant.

Once de-identified information has been combined with other participants’ information and incorporated into an aggregate report, that contribution cannot practicably be removed from or recalled within a report already created or delivered. The participant will not be named or identified in that aggregate report.

The Privacy Policy and any applicable participant consent form provide additional details about data collection, de-identification, retention, deletion requests, and reporting safeguards.

10. Email and other communications

We may use Systeme.io or another service provider to send program communications, requested information, administrative notices, and, where permitted, marketing messages. Message and data rates may apply to text messages if SMS is offered.

You may unsubscribe from marketing emails using the link in the message. You may still receive service-related or legally required communications. If SMS is offered, the applicable consent language will explain how to opt out.

11. Privacy

Live As If Co. is the controller of personal information collected through Edge to Ease, except where another arrangement is stated in a signed agreement or required by law. Our collection, use, disclosure, retention, and protection of information are described in the Edge to Ease Privacy Policy.

By using the services, you acknowledge that information will be handled as described in the Privacy Policy and any consent form presented to you. The Privacy Policy is incorporated into these Terms by reference.

12. Acceptable use

You agree not to:

• Use the website or services for an unlawful, harmful, fraudulent, or discriminatory purpose.
• Attempt to gain unauthorized access to accounts, systems, data, or reports.
• Upload malicious code or interfere with the security, integrity, or operation of the services.
• Impersonate another person or submit information you are not authorized to provide.
• Copy, scrape, reverse engineer, resell, or commercially exploit the services except with our written permission.
• Attempt to re-identify individuals from aggregate or de-identified information.
• Use Edge to Ease information to make unauthorized individual employment, insurance, credit, housing, or healthcare decisions.

We may suspend or restrict access when we reasonably believe these Terms, another applicable agreement, or the law has been violated.

13. Intellectual property

The website, service design, methods, assessments, frameworks, Capacity Intelligence materials, Daily Clarity Stories, text, graphics, logos, trademarks, and other content are owned by Live As If Co. or used with permission and are protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, nonexclusive, nontransferable, revocable right to access and use the services for their intended purpose. No ownership rights are transferred to you.

You retain ownership of content you submit. You grant Live As If Co. the limited rights needed to receive, host, process, analyze, de-identify, aggregate, and use that content to provide, secure, maintain, and improve the services, subject to the Privacy Policy and applicable agreements.

14. Third-party services and links

The services may rely on or link to third-party platforms, devices, AI providers, email services, scheduling tools, hosting services, or other vendors. Third parties operate under their own terms and privacy practices. We are not responsible for third-party websites, services, availability, or content that we do not control.

A link or integration does not imply endorsement of every third-party product, statement, or practice.

15. Availability, updates, and termination

We may update, modify, suspend, or discontinue all or part of the website or services, including features offered during a pilot. We do not guarantee uninterrupted, error-free, or secure availability.

You may stop using the services at any time. We may suspend or terminate access for a material violation of these Terms, a security risk, nonpayment under an applicable agreement, or as otherwise permitted by law or contract.

16. Disclaimers

To the fullest extent permitted by law, the website and services are provided “as is” and “as available.” Live As If Co. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and reliability.

We do not guarantee any particular health, workplace, engagement, retention, productivity, financial, or organizational outcome. Individual and organizational results vary, and insights may be affected by incomplete information, participation levels, technology limits, and other factors outside our control.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

17. Limitation of liability

To the fullest extent permitted by law, Live As If Co. and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to the website or services.

To the fullest extent permitted by law, the total liability of Live As If Co. for all claims arising from or related to the services will not exceed the amount you personally paid to Live As If Co. for the applicable service during the twelve months before the event giving rise to the claim, or one hundred U.S. dollars if you paid nothing directly.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Live As If Co. and its owners, officers, employees, and contractors from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful misuse of the services, your violation of these Terms, or your infringement of another person’s rights.

19. Governing law and venue

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Unless an applicable written agreement requires a different process, any dispute arising from these Terms or the services must be brought in a state or federal court with jurisdiction in Wayne County, Michigan, and each party consents to that venue.

Before filing a claim, you agree to contact us and make a good-faith effort to resolve the concern informally. Nothing in this section prevents either party from seeking urgent injunctive relief or exercising a right that cannot legally be waived.

20. General provisions

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a reorganization, merger, sale, or transfer of the services.

These Terms and the documents incorporated by reference are the entire agreement between you and Live As If Co. concerning their subject matter, except for any applicable signed agreement.

We may revise these Terms from time to time. The updated effective date will appear at the top of this page. If a change is material, we will provide notice where required by law. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
